The Minister for Justice and Law Reform, Mr. Dermot Ahern, T.D., today welcomed publication of the Law Reform Commission Report on personal debt. He said it was an important contribution to the Government’s change programme in relation to enforcement of debt and the personal debt process.
The Renewed Programme for Government (October 2009) indicated that debt enforcement would be reformed in light of the deliberations of the Law Reform Commission.
The commitment in the Programme of Financial Support for Ireland is for legislation to reform the bankruptcy regime to be presented to the Houses of the Oireachtas by end of 2012.
The Minister said: "I have already implemented by way of publication of the Civil Law (Miscellaneous Provisions) Bill 2010 the interim recommendation of the Law Reform Commission to reduce the 12 year period for discharge of a bankruptcy to 6 years. The Bill also provides for automatic discharge of a bankruptcy where the adjudication order has existed for 20 years."
The Minister added: "I want to thank the Commission for its very substantial research and examination of the law. It is also discussing the issue at their Conference today in Dublin Castle. The wide ranging recommendations will now be examined by my Department with a view to implementation as quickly as possible."
